1. Acceptance of Terms

By accessing or using the Northwind Lending website (the "Site") or submitting a funding application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site. These Terms apply to all visitors, users, and applicants.

2. Eligibility

To use our services or submit an application, you must be at least 18 years of age, a legal representative authorized to act on behalf of the business you represent, and located in the United States. By applying, you represent and warrant that all information you provide is accurate, current, and complete.

3. Description of Services

Northwind Lending provides an online platform through which businesses may request information about and apply for various commercial funding products, including lines of credit, term loans, invoice factoring, equipment financing, merchant cash advances, and SBA loan facilitation. We may match applicants with funding options and provide advisory support.

• We do not provide legal, tax, or accounting advice.
• Product availability, amounts, rates, and terms vary and are subject to underwriting.
• Some products may be offered through third-party funding partners.

4. Applications & No Guarantee

Submitting an application does not guarantee approval or funding. All applications are subject to review, verification, and underwriting. Estimates, calculators, and pre-qualification indications presented on the Site are illustrative only and do not constitute an offer or commitment to lend. Any binding offer will be provided separately in writing.

5. Fees

There is no cost to apply or to receive a funding estimate. If you accept a funding offer, applicable fees, interest, factor rates, or other charges will be clearly disclosed in your funding agreement before you sign. You are responsible for reviewing and understanding all such terms prior to acceptance.

6. User Obligations

When using the Site, you agree that you will not:

• Provide false, misleading, or fraudulent information;
• Use the Site for any unlawful purpose or in violation of these Terms;
• Attempt to gain unauthorized access to our systems or data;
• Interfere with or disrupt the integrity or performance of the Site;
• Reproduce, duplicate, or resell any portion of the Site without written permission.

7. Disclaimers

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Suffolk County, Massachusetts.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the Site after any change constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
